Subpoena Deadlines

10 Days Prior to Hearing:

All subpoena requests required to be filed with the judge must be filed no later than ten days prior to the hearing.  This includes the following situations:

  1. A party intends to subpoena more than two peace officers to testify as witnesses.
  2. A party seeks to compel the presence of witnesses who are not peace officers.
  3. A defendant, who is not represented by an attorney, seeks to compel the presence of witnesses.

A copy of the request must be filed with DPS at the same time the request is filed with SOAH.

5 Calendar Days Prior to the Hearing:

All subpoenas, whether issued by an attorney or a judge, must be served at least five calendar days prior to the hearing.

A copy of an attorney-issued subpoena must be filed with DPS on the same date it is issued.

A copy of the return of service must be filed with DPS and SOAH when the subpoena has been served.

3 Calendar Days Prior to the Hearing:

A check or money order payable to the witness must be filed with SOAH at least three calendar days prior to the hearing.  This payment should include the $10 witness fee plus mileage (when applicable).

A copy of the return of service must be filed with DPS and SOAH no later than three calendar days prior to the hearing.
